Pfizer, one of the world’s largest drug companies, has agreed to pay up to one million rupees (Rs 2,400 crore) to settle a case filed in a US district court against its US sales partner, Eli Lilly and Company.

Pfizer had filed a lawsuit in the US District Court in Houston, alleging that the company had been unfair and deceptive in using the Viagra sales deal to get FDA approval for the drug.
In its lawsuit, filed on October 13, 2002, the company alleged that the US patent on the drug was invalid, and had not been applied to it. It claimed that Lilly’s conduct was “improper and unfair, and that the product was a fair and equitable use of the patent, which in turn would infringe the rights of the patent holder”.
In 2004 the court in Karachi, Pakistan, in a case that is still pending in the US, ruled against Pfizer, after finding that the alleged unfair competition claim was “unHAEL-able”, and that the alleged unfair competition claim was “uncounterweighting”.
Pfizer is facing a lawsuit in the US District Court for the District of Minnesota, alleging that the US patent on the Viagra brand was invalid, and had not been applied to it. In 2005 Pfizer’s patent on the erectile dysfunction drug was also invalid.
The court ruled that Pfizer’s conduct was not “improper and unfair”, in the first place, and had been “improper and unfair” when the US patent on the drug was invalid.
The court noted that Pfizer had failed to seek approval of the Viagra product to market and the US patent on the erectile dysfunction drug to treat male impotence was inapplicable to its Viagra products.
